Ice on Texas roads can create a treacherous environment, leading to car crashes and serious personal injuries. Because snowy and icy roads are such a rare occurrence in our state, many of our cities are unfortunately ill-equipped to make roads safe when severe winter weather hits. It is extremely important that drivers exercise tremendous caution when driving in these conditions. In Texas, every driver is responsible for driving safely on icy roads and in manner that does not cause them to crash into another vehicle. How we define “safe” depends on the circumstances. When snow and ice form on our roads, drivers have a heightened duty to act as a reasonably prudent person would under the circumstances. That includes taking into account the effect that slippery conditions can have on their vehicle and being extremely cautious. Drivers who fail to take these actions, either because they are driving too fast or too close to other vehicles or on tires without sufficient tread, do not get a pass on taking responsibility for their actions by blaming snow or ice. It is ultimately their responsibility not to crash into another vehicle…period.
Vehicle pileups, which are also likely to occur in these conditions, can be particularly complex in determining who is responsible because of the fact that there are often multiple impacts to the same vehicle. This may leave someone who is seriously injured or has lost a loved one in the position of having several insurance companies pointing fingers at each other – none of whom want to take responsibility for the actions of their insured drivers.
